What Constitutes Drunk Driving in Georgia?

A driver can be in violation of DUI laws in Georgia in either one of two different ways:

  • Driving under the influence: A driver is considered under the influence if he or she has consumed alcohol and is unable to operate the vehicle safely. The person’s driving and/or field sobriety tests are the basis for determining whether the driver was mentally or physically impaired.
  • DUI Per Se: As in most states, driving with blood alcohol concentration (BAC) of 0.08 or greater is against the law in Georgia. A driver under the age of 21 with a BAC of 0.02 or higher is considered DUI. A commercial driver is DUI with a BAC of 0.04 or greater.

  • The NHTSA reports that 10,874 people in the U.S. were killed in drunk driving crashes in a recently reported year.
  • 6,618 of those fatalities (61%) were drivers with a BAC of 0.08 or higher.

  • Approximately one-third of all traffic fatalities in the U.S. involve drivers with BAC of 0.08 or higher.
